Terms of Service

Welcome to ApexLift. These Terms of Service govern your access to and use of the ApexLift mobile application, website, and related services operated by ApexCo LLC. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use ApexLift. By using the Service, you represent that you meet the age requirements, are capable of entering into a legally binding agreement, and your use of the Service is permitted by applicable law.
2. Accounts
To use ApexLift, you must create an account. You agree to provide accurate and complete information, keep your login credentials secure, maintain control over any Google, Apple, or email account used to sign in, be responsible for activity under your account, and notify us if you believe your account has been compromised. We may suspend, restrict, or terminate accounts that violate these Terms, create risk, manipulate the platform, or harm other users.
3. Subscriptions and Billing
ApexLift is a subscription-based service. Access to some or all features may require an active subscription, trial, promotional entitlement, or other paid access. Subscriptions may be purchased through the Apple App Store, Google Play, our website, or other supported billing providers. Billing may be processed by Apple, Google, RevenueCat, Stripe, or their partners. We do not store full payment card details. Unless stated otherwise at purchase, subscriptions renew automatically, you are responsible for canceling before renewal, pricing and cancellation rules are shown by the relevant store or payment provider, and pricing may change with reasonable notice or as permitted by the applicable provider.
If you subscribe through the Apple App Store or Google Play, payment is charged to your Apple ID or Google Play account at confirmation; subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period; your account may be charged for renewal within 24 hours before the end of the current period; you can manage or cancel subscriptions in your App Store or Google Play account settings; and store-specific refund rights are governed by the applicable store rules and local law. Trials, introductory offers, beta access, tester entitlements, or promotions may be limited, modified, or discontinued. Payments are final unless otherwise required by law or by the applicable store or payment provider. Deleting your ApexLift account does not automatically cancel a subscription managed by Apple, Google, RevenueCat, Stripe, or another billing provider.
4. Acceptable Use
You agree not to use the Service for unlawful, harmful, abusive, or deceptive purposes; attempt to gain unauthorized access to systems, accounts, or data; interfere with or disrupt the Service; reverse engineer, scrape, overload, or abuse the Service except as permitted by law; exploit, manipulate, falsify, or automate workout, scoring, PvP, leaderboard, subscription, or entitlement systems; use bots, scripts, emulators, fabricated workouts, or other methods to gain unfair advantage; circumvent privacy controls, block/mute systems, rate limits, safety checks, or eligibility rules; or upload or submit malicious code, spam, or misleading content.
5. Community Standards and User Content
You agree not to create, upload, share, or use content within ApexLift that is sexually explicit or pornographic, hateful, abusive, discriminatory, harassing, threatening, violent, exploitative, obscene, offensive, misleading, fraudulent, impersonating another person or entity, infringing, or otherwise unlawful. This includes handles, display names, profile images, workout names, template names, comments, messages, shared content, and other user-generated content. We may remove or modify content, restrict access to community or competitive features, or suspend or terminate accounts when we believe these standards are violated.
6. Your Data and Content
You retain ownership of data and content you input into ApexLift, such as workout data, templates, profile content, and feedback. You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, process, display, transmit, adapt, and use your data and content as needed to provide, operate, secure, and improve the Service; deliver analytics, scoring, coaching, recovery, notifications, social, and competitive features; display content you choose to share or make visible through privacy settings; detect abuse; enforce these Terms; and protect platform integrity. This license ends when your data is deleted from active systems, except where retention is allowed under these Terms, our Privacy Policy, or applicable law.
7. Competitive Features, ApexScore, and Social Features
ApexLift includes competitive and social features such as ApexScore, leaderboards, matches, hunt targets, rivals, direct challenges, events, titles, social profile views, activity feeds, and workout or template sharing. You acknowledge that scores, rankings, match outcomes, readiness, recovery, and recommendations are calculated using proprietary systems; results may change due to new data, scoring changes, bug fixes, recalculations, anti-abuse review, or feature updates; ApexScore and related metrics are fitness product signals, not professional measurements or guarantees; and other users may see information made visible through supported social, PvP, leaderboard, or sharing features. We may modify scoring systems, leagues, matching logic, visibility rules, title logic, leaderboards, events, hunt targets, and competitive outcomes. We may remove or adjust fraudulent, abusive, corrupted, or manipulated data.
8. Health and Fitness Disclaimer
ApexLift provides fitness tracking, analytics, coaching, and informational content only. We do not provide medical advice, diagnosis, treatment, rehabilitation, physical therapy, or emergency services. The Service is not a substitute for a physician, licensed trainer, physical therapist, or other qualified professional. Exercise involves risk, including injury. You are responsible for deciding whether workouts, recommendations, loads, exercises, and training changes are appropriate for you. Stop exercising and seek professional advice if you experience pain, dizziness, shortness of breath, or other concerning symptoms. Consult a qualified professional before beginning or changing an exercise program, especially if you have a medical condition, injury, or other health concern. Use of the Service is at your own risk.
9. Health Integrations
If you connect Apple Health, HealthKit, Health Connect, or similar health platforms, you authorize ApexLift to read or write the data types you approve through the applicable platform permission screens. You are responsible for managing permissions through your device or platform settings. We are not responsible for inaccurate, incomplete, delayed, duplicated, or unavailable data from health platforms or connected devices. Health integration data is used to provide app functionality such as tracking, recovery, analytics, and coaching. It is not intended for medical use.
10. AI and Coaching Features
ApexLift may provide coaching insights, recommendations, summaries, or feedback generated by automated systems and artificial intelligence technologies, including third-party infrastructure where applicable. You acknowledge that coaching insights are informational only; recommendations may be incomplete, inaccurate, delayed, or unsuitable for your circumstances; automated systems may misinterpret data or produce unexpected outputs; and you are solely responsible for how you interpret and apply guidance. ApexLift makes no guarantees regarding accuracy of AI-generated or automated outputs, training outcomes, injury prevention, recovery, readiness, performance improvements, or suitability of recommendations for your body, equipment, goals, or circumstances. We may modify, limit, suspend, or discontinue AI or coaching features at any time.
11. Connected Third-Party Services
The Service may integrate with third-party services such as Strava, Apple Health, Health Connect, Google, Apple, Supabase, RevenueCat, app stores, analytics providers, monitoring providers, and other tools. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, data availability, outages, decisions, policy changes, or account restrictions. If you connect Strava or another sharing service, you are responsible for the content you choose to share and for complying with that service's rules.
12. Privacy
Our Privacy Policy explains how we collect, use, disclose, and safeguard information. By using the Service, you acknowledge our Privacy Policy. Privacy controls affect supported app surfaces, but no privacy setting can guarantee that information already shared, viewed, cached, exported, screenshotted, or processed for safety, audit, billing, legal, or integrity purposes will be fully removed from all contexts.
13. Account Deletion and Termination
You may stop using the Service at any time. You may request account deletion through supported in-app settings or by contacting us. We may suspend, restrict, or terminate your access to the Service if you violate these Terms, post or share prohibited content, pose risk to the platform or other users, manipulate or attempt to manipulate scoring, billing, identity, or competitive systems, or if we are required to do so by law or a third-party platform. Upon deletion or termination, we may delete, anonymize, or retain information as described in our Privacy Policy and as permitted by law. Some records may remain for billing, legal, security, fraud prevention, backup, dispute, audit, or platform integrity purposes. Account deletion does not automatically cancel subscriptions managed by third-party billing providers.
14. Service Changes and Availability
The Service may change over time. We may add, remove, modify, suspend, or discontinue features, pricing, scoring, coaching, integrations, events, subscriptions, or access at any time. We do not guarantee uninterrupted availability, error-free operation, data synchronization, data retention, or compatibility with all devices, platforms, wearables, health services, or third-party integrations.
15. Disclaimer of Warranties
The Service is provided as is and as available. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and fitness or health outcomes.
16. Limitation of Liability
To the maximum extent permitted by law, ApexLift and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, revenue, rankings, performance, subscriptions, or goodwill; injuries, health issues, or training outcomes resulting from use of the Service; third-party services, connected platforms, app stores, or payment providers; unauthorized access, service interruptions, bugs, sync failures, or data loss. Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by law.
17. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ApexLift, ApexCo LLC, and their owners, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your content, your violation of these Terms, or your violation of law or third-party rights.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law, such as by updating the Last Updated date, providing in-app notice, or posting notice on our website. Continued use of the Service after changes means you accept the updated Terms.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. If a dispute cannot be resolved informally, it will be resolved in the state or federal courts located in Michigan, and you consent to those courts' jurisdiction and venue, except where applicable law requires otherwise.
